    Terms and Conditions

    1.    Information on how to enter and prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.
    Who can/cannot enter
    2.    Macular Disease Foundation Australia (“Promoter”) employees and board directors, the Promoter’s agencies and contractors involved in administering this competition and judges of the mEYE World Photographic Competition, and each of their immediate families are not permitted to enter the competition (“Ineligible Entrants”). Immediate family means parents, siblings, partners, children and grandparents.
    3.    The competition categories are: Open – General Public category; Macular Disease Community category; Healthcare Professional category; and Junior category. Entry to all categories in this competition (other than entry to the Junior category of this competition) is open to Australian residents who are 18 years and over, except Ineligible Entrants. For the avoidance of doubt, entry is open to employees and family members of the Promoter’s sponsors and supporters who otherwise meet the requirements of this clause 3.
    4.    Entry to the Open – General Public category is open to all entrants who meet the requirements of clause 3.
    5.    Entry to the Macular Disease Community category is restricted to people who have macular disease and their family, friends and carers who are not excluded by another clause in these Terms and Conditions.
    6.    Entry to the Healthcare Professional category is restricted to people who work as a healthcare professional, including optometrists, ophthalmologists, general practitioners, complementary healthcare workers, nurses, pharmacists and pharmacy assistants who are not excluded by another clause in these Terms and Conditions.
    7.    Entry to the Junior category of this competition is open to Australian residents who are under the age of 18 as at 3 October 2017, except Ineligible Entrants.
    8.    All entries in the Junior category must provide contact details of a parent or guardian at the time of submission, including their name, email address and telephone number. The Promoter will make all reasonable attempts contact each entrant’s parent/guardian to verify that consent has been given by the entrant’s parent/guardian and only once such consent has been verified will the entry be valid.
    Timing
    9.    The main competition commences at 09.00 AEST on Tuesday 08 August 2017 and closes at 17.00 AEST on Tuesday 03 October 2017 (“Competition Period”).
    10.    The ‘most popular’ public voting period commences at 17.00 AEST on Tuesday 03 October 2017 and closes at 17.00 AEST on Tuesday 24 October 2017 (“First Voting Period”).
    Entry forms and requirements
    11.     To enter the main competition, individuals must complete an entry form available online at www.mdfoundation.com.au/2017meyephotocomp during the Competition Period. Entries must include a photograph taken by the entrant and 30-60 words that explain how that photograph captures the competition theme 'See My World – in your own backyard' (“Entry”). There are four categories and individuals must tick the box corresponding to the category being entered on the entry form. Entrants must only submit an Entry in categories that they are eligible to enter, in accordance with clauses 3, 4, 5, 6 and 7. Entries must be received by the Promoter during the Competition Period.  Entries received after 3 October 2017 will not be accepted.
    12.     Entrants must submit the photograph required under clause 11 as a digital JPEG file. Images must be a minimum size of 1MB and a maximum size of 10MB. Images that sit outside of the sizes noted will not be automatically disqualified. It will be at the judge's discretion as to whether they are accepted or declined based on the judging criteria.
    13.    To enter the ‘most popular’ competition, entrants must have first submitted a valid entry in the main competition during the Competition Period in accordance with clause 11 and must, during the First Voting Period:
    a)    access their own Facebook or Instagram page and upload their photograph Entry. Ensure your photo is made ‘public’ when posting your entry, so it is viewable by the judges; and
    b)    email a proof of the number of “likes”* (definition see clause 44-45) received in the form of a screenshot or photo to mdf@mdfoundation.com.au by 17:00 AEST on Tuesday 24 October 2017.   
    Entries must be uploaded during the First Voting Period.  Entries received after 24 October 2017 will not be accepted. Any Entries posted to Facebook or Instagram before the First Voting Period commences will be ineligible to win the ‘most popular’ competition.
    14.    Incomplete or illegible entries will be deemed invalid.
    15.    Entries may not be digitally enhanced or manipulated in any way (including Instagram filters). The aim of the competition is to raise awareness of macular disease and highlight just how precious our sight is. This clause is designed to encourage entrants to capture a real image from their world. The clause is not directed towards cropping photos or making other minor adjustments such as to the colour, brightness or contrast of photos. It will be at the judge's discretion as to whether they are accepted or declined.
    16.    All entries must be the original work of the author and factually accurate, to the best of the entrant’s knowledge.
    17.    Photographs entered in the 2011, 2012, 2013, 2014, 2015 and 2016 competition are not permitted to be entered into the 2017 competition or future years and any such entry shall be deemed invalid.

    Disqualification
    18.    The Promoter reserves the right, at any time, to verify the validity of Entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    19.    The Promoter reserves the right to disqualify an entry if the content is deemed inappropriate and not in accordance with the Promoter’s values which include respect, compassion, integrity and competency.

    Judging
    20.    A maximum of one Entry per category, per person, will be accepted. Each Entry must be submitted successfully on www.mdfoundation.com.au/2017meyephotocomp, and for Entries in the Junior category, a separate parental consent verification process will be completed by the Promoter to verify each Entry. If additional entries are submitted, only the first entry will be eligible for judging.
    21.    Entries are judged individually based on their merits according to the criteria set out in clauses 23 and 24. It is possible for the same person to win more than one category but it is not possible for the same photograph to win more than one category.
    22.    This competition is a game of skill. Chance plays no part in determining the winners.
    23.    For the main competition:
    (a)    Entries will be judged by a panel of judges selected by the Promoter, via teleconference arranged by the Promoter from Suite 902, Level 9, 447 Kent Street, Sydney on Thursday 2 November 2017. Judging will be based on the Entry’s creativity, composition, content and technique.
    (b)    The entrant who submits the best entry across all possible categories, as determined by the judges, will win the grand finalist prize (“Grand Finalist”). In addition, the entrant who submits the best Entry in each category, as determined by the judges, will each receive a prize (together the “Finalists”). The grand finalist will win the grand finalist prize and the finalists will each win the prize for the relevant category in which his or her entry was submitted.
    24.    For the ‘most popular’ competition:
    (a)    Entries will be judged by a panel of judges selected by the Promoter at Suite 902, Level 9, 447 Kent Street, Sydney on the dates set out below. Judging will be based on how many “likes” the entry receives cumulatively across Facebook and Instagram.
    (b)    The 5 best entries (“Top 5”), as determined by the judges on 25 October 2017 based on the number of “likes” on the Entry during the First Voting Period will be published on the Promoter’s Facebook and Instagram pages at on 25 October 2017. The Top 5 will be eligible to receive “likes” on the Promoter’s Facebook and Instagram pages from 9:00 AEST on 26 October 2017 to 17:00 AEST 9 November 2017 (“Final Voting Period”).
    (c)    The one Top 5 entrant with the highest number of “likes” at the end of the Final Voting Period as determined by the judges on 10 November 2017 will win the ‘most popular’ prize (“Most Popular”).
    25.    The judges’ decision is final and no correspondence will be entered into.
    26.    The Grand Finalist, Finalists and the Most Popular will all be notified in writing either via post or email by 17.00 AEDT on Friday 10 November 2017. The names of the prize winners will be published on www.mdfoundation.com.au/2017meyephotocomp on Tuesday 14 November 2017.

    Pornography/inappropriate images
    27.    Any images submitted are subject to review and acceptance by Macular Disease Foundation Australia in its absolute discretion. All images are subject to all applicable Australian and international laws regarding, but not limited to, child pornography, child abuse, and obscene or pornographic material. Further, entrants that upload a photograph in accordance with clause 11 must adhere to the following conditions:
    (a)    by submitting a photograph, entrants agree to the photograph being made available for public viewing, including on the Promoter’s Facebook and Instagram pages and on the social media platform through which the Entry was submitted;
    (b)    any person depicted in a photograph submitted must be decently dressed and presented;
    (c)    all photographs are subject to the approval of the Promoter. The Promoter reserves the right to vet all entries and reserves the right to remove any entries at any time in its absolute discretion. However, the Promoter is not responsible for any photographs displayed on the website and visitors to the website view it at their own risk;
    (d)    entrants must own the copyright in the photograph submitted or be entitled and have permission to use the photograph in the manner contemplated by these terms, including the use of the photograph for promotional purposed in accordance with clause 41; and
    (e)    if an entrant uploads a photograph of a child, the entrant must either be the parent or legal guardian of the child depicted in the photograph or must have permission of all parents or legal guardians of any other children depicted.

    Winners and prizes
    28.    Grand Finalist: The grand finalist’s prize consists of:

    35.    There are 3 x finalist prizes, 1 x junior finalist prize and 1 x most popular prize to be won. Total RRP of all prizes is $5,906.63
    36.    If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal or greater value, subject to any written directions from a regulatory authority.
    37.    The total prize pool is RRP $5,906.63. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash (except for the cash prize).
    38.    Gift vouchers must be redeemed before the expiry date shown on the gift voucher. Gift vouchers are subject to the terms and conditions of the third party prize suppliers, including Blue Thumb, Frame Shop, Momento, Art Pharmacy, Momento and Mainline Photographics. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of the third party prize suppliers or otherwise as a result of the winner accepting and/or using a prize (even if caused by negligence), except for any liability which cannot be excluded by law.

    Other legal terms
    39.    The judges’ decision is final and binding - no correspondence will be entered into. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.
    40.    Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
    41.    Details from entries will be collected and used in order to process and conduct the competition (which may, for this purpose, include disclosure of such information third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities) and for promotional purposes surrounding this competition. Entry is conditional on entrants consenting to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing, publicity, research and profiling purposes, without further reference or payment to the entrant. Entrants may obtain a copy of the Promoter's privacy policy and should direct any request to access, update or correct information to Macular Disease Foundation Australia on 1800 111 709 during office hours.
    42.    Entrants acknowledge that use of Facebook and Instagram is subject to the terms and conditions of Facebook and Instagram. The Promoter is not responsible or liable for any loss, damage or injury suffered by any entrant as a result of the conduct of Facebook or Instagram, including the decision of Facebook or Instagram to remove or not remove any images, except for liability which cannot be excluded by law.
    43.    In particular, the thoughts and views expressed on Facebook or Instagram, are only the thoughts and views of the individual that posted them.  They are not representative of the opinions of the Promoter, nor does the Promoter confirm, guarantee or warrant the accuracy, completeness or usefulness of any post.  This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. It is a condition of entry that each entrant grants a complete release to Facebook from any claims that they now have or may have in the future which relate to or are incidental this competition.

    44.    “Likes” on Facebook is calculated by people who have clicked the ‘thumbs up’ and ‘hearts’.
    45.    “Likes” on Instagram is calculated by people who have liked the post.

    Photo Ownership/Permission
    46.    Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party. By submitting an entry to the mEYE World Photographic Competition the entrant retains ownership of the image. Further, entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and license to use, modify and reproduce their entry for the purposes of the Promoter’s business and without the payment of any further fee or compensation, including to produce a calendar using the images, as part of a gallery of photographs at events, conferences or exhibitions and as part of an online gallery of competition entries and for other purposes support the Promoter’s endeavours to reduce the incidence and impact of macular disease in Australia. The Promoter agrees to attribute the entrant as the photographer in all instances.
    47.    Where the photograph entry contains people/persons that may be identifiable it is the photographers’ responsibility to ensure that appropriate consent is acquired before entering the competition.
